Purposes of personal data

  • Conclusion and subsequent fulfillment of the contractual obligation between the controller and the customer (Article 6, paragraph 1, letter b) of the GDPR. Such a relationship gives rise to other legal obligations and the controller must process personal data for this purpose as well (Article 6, paragraph 1, letter c) of the GDPR.
  • Marketing purposes - for these we obtain your explicit consent (Article 6, paragraph 1, letter a) of the GDPR. If you do not consent to the processing for marketing purposes, we will not send you any advertisements or news that are not directly related to your order.
  • Protection of legitimate interests (Article 6(1)(f) GDPR)
    The legitimate interests of the controller are, in particular, the proper performance of all contractual obligations of the controller, the proper performance of all legal obligations of the controller, the protection of the environment and the protection of the controller's business and property. In order to protect the business, we keep records of problem clients who complicate the operation of the business. This list is used purely for our internal needs and is not shared with anyone else.

We obtain personal data directly from you, in particular from completed forms, mutual communication or concluded contracts.

To ensure your satisfaction, fulfill legal obligations, marketing purposes and protect our legitimate interests, we process the following categories of personal data:

  • basic identification data – name, surname, billing and correspondence address, IP address, or identification number;
  • contact data – telephone number and e-mail address;
  • information about ordered goods – this is data about which products you have purchased from us, returned, complained about, etc.;
  • information from mutual communication – information from e-mails, telephone calls or other contact forms;
  • billing and transaction data – this is mainly information appearing on invoices, agreed billing conditions and received payments.

The lawfulness of processing is determined by Article 6 para. 1 GDPR, according to which processing is lawful if it is necessary for the performance of a contract, for the fulfillment of a legal obligation of the controller, for the protection of the legitimate interests of the controller or the processing is based on the consent you have given us.
The lawfulness of processing is also based on, for example, Act No. 563/1991 Coll., on accounting, Act No. 89/2012 Coll., the Civil Code or Act No. 235/2004 Coll., on value added tax.

We must provide personal data within the legal limits to state administration bodies, courts or criminal prosecution authorities and companies that technically ensure the operation of the store, order processing, payment management, etc. Specifically, these are:

  • Provider of the UpGates e-shop system, EVici webdesign s.r.o.;
  • Czech Post (Only if you choose shipping by Czech Post.);
  • Packeta (Only if you choose shipping by a company.);
  • Feldhost - email system provider (Only if you voluntarily subscribe to our newsletter. We only transfer your email address.);
  • AirBank bank (only if you pay by bank transfer or we return the payment to your account);
  • PayPal payment gateway (only if you choose to pay via this gateway);
  • Comgate payment gateway (only if you choose to pay via this gateway - online card, GooglePay, ApplePay)

We store personal data for different periods of time depending on the specific purposes of processing:

  • Order of goods: indefinitely
    The reason is the performance of the contract, the right to complaint and easier advice on your future purchases.
  • Customer account registration: for an indefinite period
    Registration is beneficial primarily for you, because you do not have to fill in all the details with each order, you have an overview of the orders made and their statuses and you have access to VIP sections. You have the right to cancel your customer account at any time and delete your personal data with us - please contact us to cancel
  • Newsletter subscription: for an indefinite period
    Subscribing to the newsletter gives you a number of benefits. In order to provide them to you, we need your express consent. You have the right to cancel the newsletter at any time by clicking on the unsubscribe link in each email sent or by asking us to do so in any other way.
  • Tax records: 10 years
    Required by the Income Tax Act and the VAT Act.
  • Regular e-mail communication: 3 years
    We delete classic e-mail continuously, the intensive deletion takes place at the end of each year and we do not store any e-mail for longer than 3 years. The only exception is problem clients, see point 4.

Customer rights related to the processing of personal data and how to exercise them?

Right to information about the processing of your personal data
You are entitled to request information from the controller as to whether or not personal data is being processed. If personal data is being processed, you have the right to request information, in particular, about the identity and contact details of the controller, the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipients of personal data, the authorised controllers, a list of your rights, the possibility of contacting the Office for Personal Data Protection, the source of the processed personal data and automated decision-making and profiling.

Right to access personal data
You are entitled to request information from the controller as to whether or not your personal data is being processed and, if so, you have access to information on the purposes of the processing, the categories of personal data concerned, the recipients or categories of recipients, the period for which personal data will be stored, information on your rights, the right to lodge a complaint with the Office for Personal Data Protection, information on the source of personal data, information on whether automated decision-making and profiling are taking place. You have the right to be provided with copies of the personal data being processed. However, the right to obtain this copy must not adversely affect the rights and freedoms of other persons.

Right to rectification
If, for example, your address, telephone number or other fact has changed, you have the right to request rectification of the personal data being processed. In addition, you have the right to have incomplete personal data completed, including by providing an additional statement.

Right to erasure (right to be forgotten)
In certain specified cases, you have the right to request that the controller delete your personal data. Such cases include, for example, that the processed data are no longer necessary for the above-mentioned purposes. The controller automatically deletes your personal data after the period of necessity has expired, but you can contact them with your request at any time. Your request is then subject to individual assessment (despite your right to erasure, the controller may have an obligation or legitimate interest to retain your personal data) and you will be informed in detail about its handling.

Right to restriction of processing
The controller processes your personal data only to the extent strictly necessary. However, if you feel that the controller, for example, exceeds the above-mentioned purposes for which it processes personal data, you can submit a request that your personal data be processed exclusively for the most necessary legal reasons or that they be blocked. Your request will then be subject to individual assessment and you will be informed in detail about its handling.

Right to data portability
If you wish the controller to provide your personal data to another controller or another company, the controller will transfer your personal data in an appropriate format to the entity designated by you, unless there are any legal or other significant obstacles preventing it from doing so.

Right to object and automated individual decision-making
If you find out or even believe that the controller is processing personal data in a way that is contrary to the protection of your private and personal life or in a way that is contrary to legal regulations, you can contact the controller and ask them to explain or eliminate the problem.

Right to file a complaint with the Office for Personal Data Protection

Right to withdraw consent
You have the right to withdraw your consent to the processing of personal data at any time.
